Introduction

This Privacy Policy describes how Airexys, Inc., a Delaware corporation (“Airexys”, “we”, “us”, or “our”), collects, uses, stores, and discloses information about you when you visit our website at www.airexys.com (the “Site”), use our mobile application (the “App”), or otherwise interact with our services (collectively, the “Services”).

Please read this Privacy Policy carefully before using the Services. By accessing or using the Services, you agree to this Privacy Policy and our Terms of Service. If you do not agree, please do not use the Services.

Information We Collect

Information You Provide to Us

  • Account information. When you create an account, we collect your email address and authentication credentials. If you sign in using a third-party sign-in service (such as Sign in with Apple), we receive the information that service provides to us, such as your email address or a private relay address.

  • Communications. If you contact us, subscribe to our email list, or respond to surveys, we collect the information you provide, such as your email address and the content of your message.

  • Payment and transaction data. Subscriptions are purchased through the Apple App Store. Payment is collected and processed by Apple under Apple’s own privacy policy and terms. We do not receive or store your payment card numbers. We may receive transaction confirmations and subscription status information (such as whether your subscription is active) in order to provide you with the Services.

Location Data

The core function of the App is to provide air quality information and personalized guidance for your location. To do this:

  • We collect your device’s location, with your permission, when you use the App.

  • Background location. If you enable background location access, the App may collect your location periodically while running in the background. We use background location solely to keep your air quality information current and to deliver timely notifications about changes in air quality near you. You can disable background location access at any time in your device settings; certain features (such as location-based alerts) will not function without it.

  • Server processing. Your location is transmitted to our servers to retrieve air quality data for your area and to generate your personalized air quality metrics.

We do not sell your location data, and we do not use your precise location for advertising purposes.

Information Collected Automatically

When you use the Services, we and our service providers may automatically collect:

  • Device and usage information, such as device model, operating system version, app version, language settings, IP address (which may indicate general location), identifiers for advertising or analytics, crash logs, and information about how you interact with the App (features used, screens viewed, session length).

  • Website data. On the Site, we and our partners use cookies, pixels, tags, and similar technologies — including the Meta Pixel, Google tags (via Google Tag Manager and Google Analytics), and the LinkedIn Insight Tag — to operate the Site, analyze traffic, measure the effectiveness of our marketing campaigns, and deliver relevant advertising. See “Cookies and Tracking Technologies” below.

Air Quality and Environmental Data

The App retrieves environmental data (such as air pollutant concentrations, indices, and related environmental conditions) from third-party and governmental data sources based on your location. This environmental data is not personal information by itself, but when combined with your location and account it is treated as personal information under this Privacy Policy.

How We Use Your Information

We use the information we collect to:

  • Provide the Services, including retrieving air quality data for your location, calculating your personalized air quality metrics, and delivering notifications you have enabled;

  • Create and manage your account and authenticate you;

  • Process and manage subscriptions, including free trials and renewals;

  • Communicate with you, including responding to support requests, sending service-related announcements, and — if you have subscribed or consented — sending marketing emails, from which you may unsubscribe at any time;

  • Analyze and improve the Services, including understanding how features are used, fixing bugs, and developing new features. Where feasible, we use aggregated or de-identified data for these purposes;

  • Measure and improve our marketing, including through the website tracking technologies described above;

  • Protect the Services, including detecting and preventing fraud, abuse, and security incidents; and

  • Comply with legal obligations.

How We Share Your Information

We do not sell your personal information for monetary consideration. We share personal information only in the following circumstances:

  • Service providers. We share information with vendors who process it on our behalf to provide the Services — such as cloud hosting and infrastructure providers, analytics and crash-reporting providers, customer support tools, email delivery services, and subscription management services. These providers are bound by contractual obligations to use the information only to provide services to us.

  • Air quality data providers. Requests to environmental data sources are made through our servers based on your location. Where technically feasible, such requests are limited to the information necessary to retrieve the relevant data.

  • Advertising and analytics partners (Site only). As described above, our Site uses tools from Meta, Google, and LinkedIn that collect information via cookies and similar technologies, subject to your cookie preferences where required by law.

  • Legal requirements. We may disclose information if we believe disclosure is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Airexys, our users, or others.

  • Corporate transactions. In connection with a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred to the relevant parties, subject to confidentiality obligations. We will make reasonable efforts to notify you if your information becomes subject to a different privacy policy.

  • With your consent or at your direction.

Cookies and Tracking Technologies

Our Site uses cookies and similar technologies for the following purposes:

  • Essential — required for the Site to function;

  • Analytics — to understand how visitors use the Site (e.g., Google Analytics);

  • Marketing — to measure campaigns and deliver relevant advertising (e.g., Meta Pixel, Google tags, LinkedIn Insight Tag).

Where required by applicable law, non-essential cookies are set only with your consent, which you can manage through our cookie banner. You can also control cookies through your browser settings and opt out of interest-based advertising through industry tools such as www.aboutads.info/choices (US) and www.youronlinechoices.eu (EU). Our Site does not respond to “Do Not Track” browser signals, but where required by law we honor the Global Privacy Control (GPC) signal as an opt-out of targeted advertising.

Data Retention

We retain personal information for as long as your account is active and as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion of your account and associated personal information at any time (see “Your Rights and Choices” below). Aggregated or de-identified data that cannot reasonably be linked to you may be retained indefinitely.

Data Security

We use commercially reasonable technical and organizational measures to protect personal information against unauthorized access, use, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you and the relevant authorities as required by applicable law.

International Data Transfers

Airexys is based in the United States, and your information is processed and stored in the United States, which may not provide the same level of data protection as the laws of your country. Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards recognized under applicable law, such as the European Commission’s Standard Contractual Clauses.

Not a Medical Service; No HIPAA Coverage

The Services provide general environmental and informational content and are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and are not a substitute for professional medical advice. Airexys is not a “covered entity” or “business associate” under the U.S. Health Insurance Portability and Accountability Act (HIPAA), and information you provide through the Services is not protected health information under HIPAA.

Children’s Privacy

The Services are not directed to children under the age of 13 (or the minimum age of digital consent in your jurisdiction, if higher). We do not knowingly collect personal information from children under this age. If we learn that we have collected personal information from a child under the applicable age without required parental consent, we will delete it promptly. Your Rights and Choices

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Access — request a copy of the personal information we hold about you;

  • Correction — request that we correct inaccurate or incomplete information;

  • Deletion — request that we delete your personal information, subject to legal exceptions;

  • Portability — request your information in a structured, commonly used, machine-readable format;

  • Objection and restriction — object to or request restriction of certain processing;

  • Withdraw consent — where processing is based on consent, withdraw it at any time without affecting prior processing;

  • Opt out of marketing — unsubscribe from marketing emails via the link in any email, and manage notification preferences in the App or your device settings.

Information for EEA, UK, and Swiss Residents

If you are located in the European Economic Area, the United Kingdom, or Switzerland, Airexys, Inc. is the data controller of your personal information. We process personal information on the following legal bases:

  • Performance of a contract — to provide the Services you request, including processing your location to deliver air quality information and managing your account and subscription;

  • Legitimate interests — to analyze and improve the Services, secure our systems, prevent fraud, and communicate with you about the Services, where these interests are not overridden by your rights;

  • Consent — for marketing emails, non-essential cookies and tracking technologies, and background location access, which you may withdraw at any time;

  • Legal obligation — where processing is necessary to comply with applicable law.

Information for US State Residents

If you reside in a US state with a comprehensive consumer privacy law (including California, Colorado, Connecticut, Texas, Virginia, and others), you may have the rights described in “Your Rights and Choices” above, as well as the right to appeal a denial of your request. This Privacy Policy describes the categories of personal information we collect, the sources of that information, our purposes for processing, and the categories of third parties with whom we share it.

We do not sell personal information for monetary consideration. Certain website advertising technologies may constitute “sharing” or “targeted advertising” under applicable state laws; you may opt out via our cookie banner, the industry tools referenced above, or by broadcasting a GPC signal.

For California residents: in the preceding 12 months, we have not sold personal information, and we have disclosed personal information only as described in this Privacy Policy.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised “Last Updated” date.
